Terms of Service

1. Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("Client," "you," or "your") and PolitiFast LLC ("PolitiFast," "we," "us," or "our"), a Wyoming limited liability company. By accessing politifast.com (the "Site") or engaging our services, you agree to be bound by these Terms. If you do not agree, you should not use the Site or our services.
2. Description of Services
PolitiFast provides the following services for political campaigns and related organizations:
- Custom campaign website design, development, and hosting
- SMS and text message communication services (subject to 10DLC compliance)
- Political consulting and digital strategy
- Content management systems and client portal access
- Add-on services including email marketing setup, donation page integration, event management, and ongoing content updates
Specific deliverables, timelines, and pricing are defined at the time of engagement and based on the selected service tier.
3. Client Accounts & Portal Access
Certain features of the Site require you to create an account. You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activity that occurs under your account
- Notifying us immediately of any unauthorized use of your account
We reserve the right to suspend or terminate accounts that violate these Terms or exhibit suspicious activity.
4. Payment Terms
- All fees are as quoted at the time of engagement and are subject to applicable taxes
- Invoices are issued through our payment processor and are due upon receipt unless otherwise agreed in writing
- Milestone-based projects may require partial payment before work begins
- Late payments may result in suspension of services until the balance is resolved
- Refunds are handled on a case-by-case basis. Work already completed and delivered is non-refundable. If a project is canceled before completion, you will be billed for work completed to date
5. Intellectual Property
What you own: You retain full ownership of all content you provide or create (text, images, media, documents), all your data (customer records, form submissions, analytics data, user accounts), and any original creative assets (logos, brand materials) created specifically for your project and paid for in full. Your content is always yours and fully portable.
What we own: PolitiFast retains ownership of our proprietary platform, content management system (CMS), all underlying application code, custom modules and features (including endorsement systems, event management, donation page frameworks, and other reusable components), themes, templates, design systems, frameworks, development tooling, and any libraries, APIs, or integrations we develop independently. Your website is a managed service built on our platform — we handle all the technical complexity so you don't have to.
If you leave: You receive a full export of your content and data in standard, portable formats (CSV, JSON, media files) at no additional charge. You do not receive access to our proprietary source code, platform, or custom-built application modules. We provide a 30-day transition period to facilitate your data migration, and can assist your new provider at our standard hourly rate.
Portfolio & marketing rights: You grant PolitiFast a non-exclusive, royalty-free right to display your completed website — including screenshots, descriptions, and links — in our portfolio, marketing materials, social media, and case studies. You may revoke this right at any time by submitting a written request to hello@politifast.com.
Third-party assets: Any third-party software, fonts, images, or libraries included in your project are subject to their respective licenses.
6. Client Responsibilities
As a client, you agree to:
- Provide accurate, complete, and lawful information for use on your campaign website
- Ensure all content you provide complies with applicable federal, state, and local laws, including FEC regulations and state election laws
- Maintain required campaign finance disclaimers ("Paid for by" disclosures) as mandated by law
- Respond to requests for content, feedback, and approvals in a timely manner to avoid project delays
- Not use our services for any unlawful, deceptive, or fraudulent purpose
PolitiFast is not responsible for the accuracy or legality of content provided by the client.
7. SMS Consent & 10DLC Compliance
If you engage our SMS communication services or if your campaign website includes text message functionality:
- All SMS campaigns must comply with the Telephone Consumer Protection Act (TCPA), 10DLC registration requirements, and applicable carrier guidelines
- You are responsible for obtaining proper consent from recipients before sending any text messages
- Recipients must be able to opt out by replying STOP at any time
- You must include required disclosures about message frequency and data rates
- PolitiFast will assist with 10DLC registration and compliance setup, but you are ultimately responsible for the content and lawfulness of messages sent through your campaigns
8. Limitation of Liability
To the maximum extent permitted by law, PolitiFast shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site or our services, including but not limited to loss of revenue, loss of data, or campaign outcomes.
Our total liability for any claim arising from these Terms or our services shall not exceed the total amount you paid to PolitiFast for the specific service giving rise to the claim.
9. Disclaimer of Warranties
The Site and our services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components. We do not guarantee any specific campaign outcomes, election results, or fundraising targets.
10. Indemnification
You agree to indemnify, defend, and hold harmless PolitiFast, its members, employees, and contractors from any claims, damages, losses, liabilities, and expenses (including reasonable attorney's fees) arising out of or related to:
- Your use of the Site or our services
- Content you provide or publish through our services
- Your violation of these Terms or any applicable law
- Your campaign's failure to comply with FEC, state election, or other regulatory requirements
11. Termination
Cancellation of hosting: You may cancel your hosting at any time by providing written notice (including email). Upon cancellation, your website will remain active for 30 days. During that period, we will make a full export of your content and data available to you. After 30 days, your website will be deactivated and hosting services will cease. No refunds are issued for partial months.
Data after cancellation: We retain a backup of your content and data for 30 days after deactivation. After that period, we may permanently delete all data. It is your responsibility to download your data export before this deadline.
What you receive: A full export of your content and data in standard portable formats (CSV, JSON, media files) at no additional charge. You do not receive our proprietary source code, platform, or custom-built modules.
Surviving provisions: Provisions regarding intellectual property, limitation of liability, indemnification, and governing law survive termination.
We reserve the right to immediately terminate services if you engage in activity that is unlawful, violates these Terms, or could harm PolitiFast's reputation.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict of laws provisions. Any disputes arising from these Terms or your use of our services shall be resolved in the courts of the State of Wyoming.
13. Changes to These Terms
We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last updated" date. Your continued use of the Site or our services after changes are posted constitutes your acceptance of the revised Terms. We encourage you to review this page periodically.
